Terms of service

of SOKJO BANKING SOLUTIONS SL, trading as RIKKI, c/ LLULL 321, 08019 BARCELONA, SPAIN, hereinafter referred to as the Seller.

1 General definitions

(1) The seller offers contactless payment devices, in particular through the online store on the website www.RIKKI.es. The following General Terms and Conditions (GTC) apply to the business relationship between the Seller and the Customer in the version valid at the time of the order.

(2) A consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed predominantly either to their commercial activity or to their independent professional activity. Entrepreneurs within the meaning of these Terms and Conditions are natural or legal persons or partnerships with legal capacity who act in the exercise of their commercial or independent professional activity when concluding the legal transaction. Customers within the meaning of the terms and conditions are both consumers and entrepreneurs.

(3) Individual contract agreements take priority over these terms and conditions. Divergent, contradictory or supplementary terms and conditions do not form part of the contract unless their validity is expressly agreed.

2 Subject matter of the contract

(1) The subject of the offer is solely the purchase of the so-called hardware. To use this hardware for contactless payment, the customer must have the “Revolut” card (a bank card that can be linked directly to the ring) or the “Curve” card (a bridge card between the buyer’s bank card and the ring). The providers of these cards are not the seller.

(2) Once the hardware has been purchased, the buyer can choose between two different procedures to link their bank card details to the hardware:

  • The buyer does it, using the Rikki app to link the “Curve” or “Revolut” card details to the ring once they have received it.
  • The seller does it, for which the buyer must provide the “Curve” or “Revolut” card details before the ring is shipped, through the secure gateway sent to the buyer by email when the ring is purchased.

(3) The seller will send the customer the ring with the card details already securely associated with each device, or without them, depending on the linking method chosen.

  • If the customer has chosen to link the card to the ring themselves, they must activate it with the same Rikki app so that it can work.
  • If the customer has chosen to have the seller do the linking, the shipping package will include a QR code to activate the ring. However, they can also use the Rikki app to activate it and to make other configurations of the ring.

(4) The payment function of contactless payment wearables depends on the validity period of the credit card registered by the customer and is limited to that period.

3 Conclusion of the contract

(1) The presentation of goods on the seller’s website does not constitute an offer in the legal sense, but only an invitation to the customer to make an offer in the legal sense. The products ordered may look slightly different from the products shown online because of technical limitations in displaying them. Colour deviations may therefore occur.

(2) The customer can place an order through the seller’s website, by email (info@rikki.io), by WhatsApp (+34 621 26 60 02) or in writing. The customer’s order constitutes a binding offer to conclude a purchase contract for the products ordered.

(3) The seller will immediately confirm receipt of the customer’s order by email.

The purchase contract is concluded:

  • a) by sending a separate email with an order confirmation, or
  • b) by delivering the goods, or
  • c) when the seller asks the customer to pay after placing their order,

whereby, if several alternatives apply, the order above is decisive for the conclusion of the contract.

4 Price

The purchase price indicated is binding. The purchase price includes value added tax (VAT). Any additional shipping costs are shown on the order confirmation page during checkout in the RIKKI online store. Packaging costs are already included in the shipping costs.

5 Payment options

The payment options available to the customer for the purchase of the goods are shown on the order payment page in the RIKKI online store.

6 Shipping

The shipping policy is set out on the “Shipping policy” page of this website.

7 Transfer of risk

(1) For consumers, the risk of accidental loss and accidental deterioration of the goods sold passes to the consumer at the time of delivery of the goods, including in the case of a mail-order purchase.

(2) For entrepreneurs, the risk of accidental loss and accidental deterioration of the goods passes to the entrepreneur at the time of delivery or, in the case of a sale shipped to a destination, at the time the goods are handed over to the forwarding agent, the carrier, or the person or institution otherwise designated to carry out the shipment.

(3) Delivery is deemed to have taken place if the customer is in default of acceptance.

8 Warranty

(1) The customer is entitled to the statutory warranty right, as modified in accordance with 8 and 9 of these GTC.

(2) The products ordered may differ slightly in colour from the products shown online. Reference is made to section 3, paragraph 1 of these GTC.

(3) Consumers have the option of demanding subsequent performance by repair or replacement. The seller is entitled to refuse the type of subsequent performance chosen if it is only possible at a disproportionate cost and the other type of subsequent performance remains without significant disadvantages for the consumer. In the case of entrepreneurs, the seller will initially provide warranty for defects in the goods, at its discretion, by repair or replacement.

(4) If subsequent performance fails, the customer may, at their discretion, accept the reduction of the purchase price (discount) offered by the Seller or cancel the contract (rescission).

(5) If the customer is an entrepreneur, only the seller’s product description is deemed agreed as the quality of the goods. Public statements, praise or advertising by the manufacturer do not represent any contractual quality of the products.

(6) The warranty period for consumers is 1 year from delivery of the goods and covers malfunction of the antenna or the NFC chip integrated in the ring. The ring is an electronic device and must be handled with care. Scratches or physical breakage of the product caused by drops, misuse, etc. are not covered by these warranties.

(7) The seller does not grant the customer any guarantee in the legal sense, unless expressly agreed otherwise. Manufacturer’s guarantees are not affected by this.

9 Limitations of liability

(1) The seller is responsible only for its own content on its online store website. Where links provide access to other websites, the seller is not responsible for any third-party content that these websites contain, nor does it adopt external content as its own. If the seller becomes aware of the presence of illegal content on external websites, it will immediately block access to those pages.

10 Final provisions and dispute resolution

(1) The laws of the Kingdom of Spain apply.

(2) We are required to inform you that, with regard to the so-called online dispute resolution by the European Commission, a corresponding online platform is provided. You can access this platform at the following link: https://ec.europa.eu/consumers/odr. In this context, we are also required to provide our email address. It is: info@rikki.io

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
